Events Outside our Control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by an Event Outside Our Control (which means any act or event beyond our reasonable control).
If an Event Outside Our Control takes place that affects the performance of our obligations under a contract:
- We will attempt to contact you as soon as reasonably possible to notify you
- Our obligations under a contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.
You may cancel a contract affected by an Event Outside Our Control. To cancel please contact us. If you opt to cancel, you will have to return (at our cost) any relevant products you have already received and we will refund the price you have paid, including any delivery charges.
We may transfer our rights and obligations under a contract to another organisation, but this will not affect your rights or our obligations under these terms.
You may only transfer your rights or your obligations under these terms to another person if we agree in writing.
This contract is between you and us. No other person shall have any rights to enforce any of its terms.
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
Terms of Sale
Please carefully read through the terms prior to placing your order, and retain a copy for your personal records.
Terms may be changed without notice, however amended changes will only apply to orders made subsequent to the date of change.
Cancellation and Return
Due to the nature of the goods that we sell, we will only accept returns on items that are defective – in which case please do get in touch as we will be eager to rectify this issue.
Please note that we reserve the right not to refund the standard shipping charge if items are returned to us for refund.
As with all goods intended for return, you have a duty of care. Please ensure that all returns are made with the original packaging to ensure there is not any damage to the product during transit.
If you are returning an item to us, it is recommended that you send it via recorded delivery so as to ensure there is a record of it’s return and confirmation of receipt. Please also provide your explanation for return, contact details, and order email on a piece of paper enclosed within the returns box.
Availability of Goods
If we are unable to service your order within the standard time frame, or at all, you will be contacted as soon as is possible. If an alternative agreement is not met, you will be offered the choice of accepting substitute goods of an equivalent value, or a refund of any sums paid.
All delivery will be made to the address given to us by you at the time of order, and will be sent in a plain brown box containing no external Kink Forge branding.
We aim to dispatch all orders within 2 to 5 working days once manufactured. Please accordingly allow for the courier transit time subsequent in any delivery time calculations.
Please also note that all toys are currently made to order, and as such the time to be manufactured will vary depending upon current order workload.
While we aim to meet the above target, please keep in in mind we are a small start up company, and if you have any queries about your order having not yet received it, please get in touch with us.
Upon receipt of the goods, please ensure that you inspect the goods and advise us as soon as possible if you have not received the correct goods, or have received faulty/damaged goods.
Please note that as a consumer you have certain statutory rights by law, and that these terms and conditions do not, and shall not, affect those rights.
If any provision of the terms listed is unenforceable this will not stop the rest of the provisions from being enforceable.
